Terms and conditions

The Association agrees to let and the Tenant agrees to take subject to the conditions contained herein from the (date of assumption) until 30th day of September (current year) and thereafter on a yearly tenancy from the First day of October (determinable as hereinafter provided), the Allotment Garden(s) being plots No(s)…………………….  on  Rosedale Road/Bull Meadow Allotment Garden.

TERMS AND CONDITIONS

The Tenant shall pay to the Association for the use of the Allotment Garden An annual rent,(inclusive of water, and required insurances) (as amended from time to time) payable annually in advance by 1st October, or on the date of the execution of this agreement, a proportionate amount of rent for any part of the year over which the tenancy may extend. (a year expires on 30th) Late payment will incur a fine of £10.

The Association may vary the annual inclusive rent payable by the tenant after giving at least three months’ notice to the tenant of such variation

The annual rent paid will include the cost of water invoices received by the Association payable by the committee, however, there will be a charge of £3 (reviewed annually) to the tenant to fill IBC tanks. Barrels will be charged pro-rata. Should a shortfall in monies occur, any outstanding balance will be divided by each plot holder, which each should pay.

The Committee agrees that all new members (from Jan. 2021) should pay a £50 deposit, which will include £10 deposit for site key. This will be refunded if/when the member leaves the association and returns the key, if the plot is in good condition and not overgrown.

The tenant agrees to notify the association of any changes to their details. Address, contact numbers etc.

An officer of the committee shall be entitled to enter and inspect the allotment garden at any time.  The committee have the right to refuse admittance to any person other than the tenant or member of their family unless accompanied by the tenant.

The tenant agrees to notify the committee of any long-term absence from the site which will leave the plot unattended for more than one month.

The tenant is responsible for ensuring that the plot number is shown in a visible position so that in case of emergency the location is easily locatable

For the safety of female members, the gates should be locked at all times

Whilst on site the tenant is fully responsible for the behaviour of any friends or family that may accompany them or acting on their behalf, this includes the correct locking of the gate when entering/leaving the site.

The tenant, when notified will remove any blighted produce from the site within 48 hours. When notified of a work party the tenant should make every effort to attend.

TENANT CONDUCT

The tenant shall not cause a nuisance or inconvenience to the occupiers of other allotment gardens or encroach upon or obstruct the road, paths or allotment  garden set out for the use of such occupiers.

The tenant shall not be abusive verbally or by any electronic method or behave in a threatening manner to any other plot holder, such behaviour is subject to  eviction from the site. If a problem does arise, contact a member of the committee for help in resolving such issues.

The tenant shall at all times supervise their children whilst on the allotment  gardens. For the safety of all, children must not be allowed to wander the site. They are also not permitted to go on to any members plot without their permission..

Any cases of disputes between plot holders of an allotment garden shall be referred to the Committee.

PLOT USES AND UPKEEP

The tenant shall use the allotment garden site wholly or mainly for the cultivation of vegetables or fruit crops, flowers and permitted livestock for the consumption by tenant or their family and shall not use the plot for the purpose of trade or business.

The tenant shall agree to cultivate to a reasonable standard of the allotment garden  within 12 WEEKS of this agreement or the agreement will be terminated and the cost of clearing the plot will be deducted from any monies paid. Plot to be inspected  after 6 weeks to check on progress.

The tenant shall to the satisfaction of the Association keep the allotment garden free from weeds where possible. Failure of compliance may result in termination of tenancy.  Weeds should NOT be allowed to go to seed. Inspections can be carried out at any time.  At least 75% of your plot should have produce growing within the first 6 months of your tenancy.

The tenant shall not sub-let any part of his plot.

The tenant shall not take, sell or carry away any mineral, gravel, sand or lay on the site of the allotment garden.

The tenant shall keep the south side path of his plot free from weeds, repair any damage done to any fences/gates on the allotment garden. These paths should also be kept clear at all times.

Fruit trees or bushes which take more than 12 months to mature should not be planted. Trees and frames should preferably be no more than 7 ft., however if they  are above this, but no more than 12ft and cause a problem e.g., shade or roots to neighbouring plots, the Committee will on a majority vote decide on action to be taken.

A water harvesting system should be set up to collect rainwater as soon as possible. THE USE OF HOSEPIPES IS NOT PERMITTED. Self-filling troughs are on site for your use. TROUGHS MUST NOT BE USED FOR WASHING PRODUCE/TOOLS.  During dry spells there will be a charge for filling your tanks/barrels if needed, which will be carried out by a delegated committee member. There will be a tap exclusively for hand washing/drinking water (at user’s own risk) at each end of Rosedale Road, and one at Bull Meadow.

The tenant must use the designated parking areas and shall not park on allotment plots or paths.

The tenant should make sure the plot is left tidy during the winter months if they do not intend to return until the spring.  

Any tenant installing a wild life pond should ensure it is child safe. 

                          SHEDS, GREENHOUSE, POLYTUNNELS  AND OTHER BUILDINGS

The tenant shall agree to restrict to use of poly/tunnels/greenhouses to a maximum of 50% of the rented area and should be maintained to a good appearance and in a safe state.

Sheds should be no larger than 8 x 10 ft. The tenant can apply to the committee to erect a larger building.

No building on site can be used for the purpose of human habitation.

BIN FIRES AND BONFIRES

The tenant shall not burn any item or permit a bonfire which is likely to cause a nuisance to  neighbouring residents or other allotment holders. In the event of burning debris, the following precautions should be followed: check wind direction, that it is blowing away from houses

Fires are not to be left unattended at any time

ANIMALS AND LIVESTOCK

The tenant shall not, without prior written consent of the association, keep or permit to be kept, any animals or livestock of any kind on site except hens or rabbits to the extent permitted by the Allotments Act 1950, section 12.

Domestic animal should be kept on a lead at all times and not be allowed to wander freely around the site.

MUST NOTS

The tenant shall NOT deposit or allow other persons to deposit on the allotment garden, any refuse or other noxious matter which is likely to cause nuisance/inconvenience to other plot holders or nearby residential properties.

Carpet must NOT be used on the allotment site.

No toxic, poisonous or hazardous material e.g. asbestos roofing is to be brought onto the Allotment Site

The tenant shall not remove produce etc from another plot without the holder’s permission

END OF TENANCY

On the death of the tenant, subject to the tenant’s executors or Administrator being allowed reasonable time to remove from the allotment site any animals, and crops belonging to the Tenant and to comply with the terms of the Agreement in regard to buildings and   reinstatement (tenancy may be transferred to family members for the unexpired portion of the allotment year, but a new tenancy agreement will be required from the commencement of the new year (October 1st) If tenancy is not taken up, the plot will be made available to other tenants/prospective tenants.

The tenancy may also be terminated by the committee after giving one months’ notice to the tenant:

  • If the rent is in arrears for not less than 30 days.                                                  
  • If it appears to the committee that there has been a breach in the terms and conditions of this agreement.
  • If the tenant has allowed the plot to become overgrown, they will be given 3 warnings (red cards) and If these are not heeded, notice of eviction will be given. You must notify us of any difficulties.

IT IS OUR POLICY AT ROSEDALE ROAD AND BULL MEADOW ALLOTMENT SITES TO ENSURE THAT EVERYONE ABIDES BY THESE TERMS AND CONDITIONS. HOWEVER, THESE CONDITIONS WILL BE SUBJECT TO CHANGE IF A SITUATION ARISES THAT WE HAVE NOT YET FORSEEN.

THE COMMITTEE RESERVE THE RIGHT TO DISREGARD ANY OF THE ABOVE TERMS AND CONDITIONS IN THE INTEREST AND WELLBEING OF THE SITE.
